LEGAL NOTICE

TOWN OF PINE PLAINS TOWN BOARD

PLEASE TAKE NOTICE that the attached Resolution was passed by the Pine Plains Town Board on June 21, 2018 subject to permissive referendum as provided by law.

WHEREAS, the Town of Pine Plains entered into a certain Land Use Agreement dated October 1, 2000, pursuant to which the Town leased a portion of a parcel of land consisting of a 6,400 square foot property located at, or near, the Town water tower on behalf of Pine Plains Water Improvement Area No. 1 to ACC Tower Sub LLC, their predecessors in interest; and

WHEREAS, the Lease Agreement has been assigned to ACC Towner Sub LLC, and has been amended, from time to time, since 2000; and

WHEREAS, American Tower has offered to enter into a longer term Lease Agreement with the Town of Pine Plains with eight (8) additional five (5) year terms with all rental payments and escalation costs remaining in full force and effect, but with a one-time signing bonus paid to the Town of $75,000; and

WHEREAS, the Attorney to the Town and the Town Board have reviewed the proposed Second Amendment to Land Lease Agreement which provides, in relevant part, for this extension and have determined that the Agreement is acceptable and that the execution of the same would be in the best interest of the Town of Pine Plains.

NOW, THEREFORE, be it RESOLVED that the Town Supervisor is hereby authorized to execute a Second Amendment to Land Use Agreement in the same, or substantially similar, form with ACC Tower Sub LLC and to execute such other and further documents as may be necessary to achieve consummation of said Agreement; and be it further

RESOLVED, that this Resolution shall be subject to a permissive referendum as provided by law.

This  motion  was  offered  by  Town Board  member Jones and was seconded by Town Board member Chase.

A meeting of the lot owners of the Amenia Island Cemetery Association will be held on Tuesday, July 24, 2018, at 6 p.m. at the Amenia Town Hall, 4988 Route 22, Amenia, N.Y. 12501 for the purpose of electing trustees and for such other matters that may properly come before the meeting.

The annual meeting of the trustees will immediately follow the meeting of the lot owners.
