NOTICE OF ELECTION

NORTH EAST FIRE DISTRICT IN THE TOWN OF NORTH EAST,

DUTCHESS COUNTY, 

NEW YORK

NOTICE IS HEREBY GIVEN that, pursuant to Section 38.00 of the Local Finance Law and Section 179 of the Town Law, an election of the qualified voters of the North East Fire District in the Town of North East, Dutchess County, New York, will be held on December 12, 2017, at the North East Fire District Station, 24 Century Boulevard, Town of North East, Village of Millerton, New York, in said Fire District, between the hours of 6:00 o’clock P.M., and 9:00 P.M., for the purpose of voting by ballot on the adoption or rejection of the following resolution:

A RESOLUTION AUTHORIZING THE ISSUANCE OF $300,000.00 BONDS OF THE NORTH EAST FIRE DISTRICT IN THE TOWN OF NORTH EAST, DUTCHESS COUNTY, NEW YORK, TO FINANCE THE COST OF THE PURCHASE OF A 2018 CLASS A PUMPER, AT A MAXIMUM ESTIMATED COST OF $600,000.

BE IT RESOLVED, by the Board of Fire Commissioners of the North East Fire District in the Town of North East, Dutchess County, New York (the “Fire District”), as follows:

Section 1. The purchase of a 2018 Class A Pumper is hereby authorized at a maximum estimated cost of $600,000.00.

Section 2. It is hereby determined that the plan for the financing of such purchase is by the issuance of $300,000.00 bonds of said Fire District, hereby authorized to be issued therefor pursuant to the provisions of the Local Finance Law and for the expenditure of $300,000.00 from the North East Fire District Reserve Fund.

Section 3. It is hereby further determined that the period of probable usefulness of the aforesaid specific purpose is twenty (20) years, pursuant to subdivision 27 of paragraph a. of Section 11.00 of the Local Finance Law.

Section 4. The faith and credit of the North East Fire District in the Town of North East, Dutchess County, New York, is hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year.  There shall annually be levied on all the taxable real property in said Fire District, a tax without limitation as to rate or amount sufficient to pay the principal of and interest on such bonds as the same become due and payable.

Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Fire District Treasurer, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Fire District Treasurer, consistent with the provisions of the Local Finance Law.

Section 6. Such bonds shall be in fully registered form and shall be signed in the name of the North East Fire District in the Town of North East, Dutchess County, New York, by the manual or facsimile signature of the Fire District Treasurer and may be attested by the manual or facsimile signature of the Fire District Secretary.

Section 7. The powers and duties of advertising such bonds for sale, conducting the sale and awarding the bonds, including private sale of the bonds, are hereby delegated to the Fire District Treasurer, who shall advertise such bonds for sale, conduct the sale, and award the bonds in such manner as he shall deem best for the interests of the Fire District; provided, however, that in the exercise of these delegated powers, he shall comply fully with the provisions of the Local Finance Law and any order or rule of the State Comptroller applicable to the sale of municipal bonds.  The receipt of the Fire District Treasurer shall be a full acquittance to the purchaser of such bonds, who shall not be obliged to see to the application of the purchase money.

Section 8. All other matters, except as provided herein relating to such bonds, including determining whether to issue such bonds having substantially level or declining annual debt service and all matters related thereto, prescribing whether manual or facsimile signatures shall appear on said bonds, prescribing the method for the recording of ownership of said bonds, appointing the fiscal agent or agents for said bonds, providing for the printing and delivery of said bonds (and if said bonds are to be executed in the name of the Fire District by the facsimile signature of its Fire District Treasurer, providing for the manual countersignature of a fiscal agent or of a designated official of the Fire District), the date, denominations, maturities and interest payment dates, place or places of payment, and also including the consolidation with other issues, shall be determined by the Fire District Treasurer.  It is hereby determined that it is to the financial advantage of the Fire District not to impose and collect from registered owners of such serial bonds any charges for mailing, shipping and insuring bonds transferred or exchanged by the fiscal agent, and, accordingly, pursuant to paragraph c of Section 70.00 of the Local Finance Law, no such charges shall be so collected by the fiscal agent.  Such bonds shall contain substantially the recital of validity clause provided for in section 52.00 of the Local Finance Law and shall otherwise be in such form and contain such recitals in addition to those required by section 52.00 of the Local Finance Law, as the Fire District Treasurer shall determine.

Section 9. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150 - 2.  Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein.

Section 10. The validity of such bonds and bond anticipation notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Fire District is not authorized to expend money, or

2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or

3) Such obligations are authorized in violation of the provisions of the Constitution.

Section 11. Upon this resolution taking effect, the same shall be published in full in the Poughkeepsie Journal, which is the official newspaper of said Fire District for such purpose, together with a notice of the Fire District Secretary in substantially the form provided in Section 81.00 of the Local Finance Law.

Section 12. This resolution is adopted subject to approval at an election of the qualified voters of the North East Fire District in the Town of North East, Dutchess County, New York  to be held on December 12, 2017.

ANNUAL ELECTION OF THE PINE PLAINS 

FIRE DISTRICT

DECEMBER 12, 2017

Please take notice, that the annual election of the Pine Plains Fire District will take place December 12, 2017, between the hours of 6:00 PM and 9:00 PM, at the Pine Plains Firehouse located at 7 Lake Road for the purpose of electing ONE Commissioner for a 5 year term, commencing on January 1, 2018 and ending December 31, 2022 and ONE commissioner for a 1 year term, commencing on January 1, 2018 and ending December 31, 2018. All  voters registered with the Dutchess County Board of Elections on or before November 21, 2017 to be eligible to vote.  Candidates for District Office shall file their name with the Secretary of the Pine Plains Fire District, Heather Lamont, PO Box 860, Pine Plains, N.Y. 12567, no later than 20 days before the election, November 22, 2017. The candidates must indicate when filing their name which office they are seeking.

TOWN OF AMENIA ZONING BOARD OF APPEALS

NOTICE OF EXTENDED PUBLIC HEARING AND APPEAL

PLEASE TAKE NOTICE that Highway Displays, Inc. (the “Applicant”) has appealed Notices of Violation and Orders of Remedy issued by the Town Code Enforcement Officer determining that certain outdoor advertising signs (billboards) Applicant owns on properties designated as Town of Amenia Grid NOs. 7065-00-596985 (253 Deep Hollow Road), and 7168-00-886575 (5272 Route 22) are prohibited by the Town Code and must be removed (the “Appeal”).  The Applicant has also requested that the Zoning Board of Appeals grant temporary variances under Town of Amenia Zoning Code 121-39.D.6 (“Sign Variances”) extending the time period these signs may remain in place. 

PLEASE TAKE FURTHER NOTICE that the Zoning Board of Appeals will hold a public hearing on the Appeal and Sign Variances on November 20, 2017 at 7:00 P.M. at Amenia Town Hall, 4988 Route 22, Amenia, New York 12501.

 

PLEASE TAKE FURTHER NOTICE that copies of the Appeal and Sign Variances request are on file in the Amenia Town Clerk’s Office for public viewing and inspection during normal business hours.  The documents can also be viewed and downloaded from the Town’s official website at www.ameniany.gov.

PLEASE TAKE FURTHER NOTICE that the Zoning Board of Appeals will hear all persons interested in the Appeal and Sign Variances at the public hearing noticed herein.  All persons may appear at the hearing in person or by agent, and may also submit written comments to the Zoning Board of Appeals at or prior to such hearing.

ANNUAL ELECTION OF AMENIA FIRE DISTRICT #1

DECEMBER 12, 2017

PLEASE TAKE NOTICE that the Annual Election of the Amenia Fire District #1 will take place on December 12, 2017 between the hours of 6:00 p.m. and 9:00 p.m. at the firehouse located at 36 Mechanic Street, Amenia, New York for the purpose of electing (3) three Commissioners of which one (1) Commissioner will serve a five (5) year term commencing of January 1, 2018 and ending on December 31, 2022; one (1) Commissioner will fill an unexpired term commencing of 1/1/2018 and ending on December 31, 2021; and one (1) Commissioner will fill an unexpired term commencing of 1/1/2018 and ending on December 31, 2018.

Candidates for District Office of Commissioner must submit their request in writing to the District Secretary at PO Box 214, Amenia, New York, to be placed on the ballot no later than November 22, 2017. Request must clearly state which commissioner seat the candidate seeks by stating the term to which he/she wishes to be placed on the ballot. 

All residents of the Fire District duly registered with the Dutchess County Board of Elections as of November 20, 2017 shall be eligible to vote.
