Closing arguments in Bennett College demolition

MILLBROOK — The fate of the Bennett College buildings was the talk of the town last week. Village trustees and residents alike listened to the last two experts and the attorneys’ summations in the Bennett College demolition hearing on Tuesday, June 29, at the Millbrook Firehouse.

Under questioning from Mark Miller from the law firm of Veneziano and Associates, Jim Tyger, town of Washington and village of Millbrook assessor, explained that the Halcyon building is currently valued for tax purposes at more than $1 million. Another expert stated that the proper permissions to demolish the buildings would take only five, or in  the worst case scenario up to, 60 days.

Richard Blumenthal, the property’s developer, was not present to hear his attorney, Miller, make the closing argument.

This is what Miller argued: The property owner’s basic position remains unchanged. He intends to demolish the Bennett College buildings, but not now. They have been in the same condition for 35 years and haven’t collapsed yet. The developer has taken reasonable precautions to secure the buildings and the only danger is to trespassers. The village has acted capriciously in its order to immediately bring down the buildings.

Village Attorney Rebecca Valk argued that the buildings are unsafe, so unsafe that structural engineers will not enter them, and that they represent imminent danger to health, life and safety.

“There is nothing in the record to dispute this,â€� Valk argued.  “The village can’t wait for an undefined point in time.â€�

Attorneys for both sides have until July 19 to present their case in writing to Judge Richard Golden; he then has 30 days to render a decision. After the summations ended Golden informed the attorneys that he wants to render his opinion as quickly as possible.
