NOTICE OF ANNUAL PUBLIC HEARING ON THE BUDGET, ANNUAL MEETING, SCHOOL DISTRICT ELECTION AND VOTE

NOTICE IS HEREBY GIVEN that the Board of Education of the Northeast Central School District, Dutchess and Columbia Counties, New York, will hold a Public Hearing on the Budget in the High School Library at the Webutuck High School Building, Haight Road, Amenia, New York, on Monday, May 9, 2016 at 7:00 P.M., for the purpose of presenting the budget document for the 2016-2017 School Year.

NOTICE IS FURTHER GIVEN that a copy of the statement of the amount of money which will be required for School District purposes during the 2016-2017 school year (the Budget), exclusive of public monies, may be obtained by any resident of the District during business hours, between 9:00 A.M. and 3:00 P.M. at the Webutuck Elementary School, Eugene Brooks Intermediate School and Webutuck High School and at the District Administrative Office between 9:00 A.M. and 4:00 P.M., effective April 22, 2016, except Saturday, Sunday or holidays.  Copies of the Budget will also be available at the Northeast-Millerton Library and the Amenia Free Library.

NOTICE IS FURTHER GIVEN that the Annual Meeting, Election of Members of the Board of Education and Vote on the Budget, will be held on Tuesday, May 17, 2016 at the Webutuck High School gym, Haight Road, Amenia, New York, between the hours of 12:00 Noon and 9:00 P.M., prevailing time, when the polls will be open for the purpose of voting by voting machine: To elect two (2) members to the Board of Education, for three-year terms, commencing July 1, 2016 and expiring on June 30, 2019.   

B.  PROPOSITION I: 2016-2017 SCHOOL BUDGET

SHALL the 2016-2017 Budget in the amount of $21,705,934 adopted by the Board of Education with anticipated revenue exclusive of taxes in the amount of $8,511,183 and the amount to be raised through taxes of $13,194,751 be approved?  Adoption of this budget requires a tax levy increase of 1.98% which exceeds the statutory tax levy increase limit for this school fiscal year and therefore exceeds the state tax cap and must be approved by sixty percent of the qualified voters present and voting. 

C. PROPOSITION II: 2016-2017 Transportation Vehicle Purchase

SHALL the Board of Education of the Webutuck Central School District be authorized to: (1) acquire two (2) school buses and security cameras on entire fleet at a maximum aggregate cost of not to exceed $250,000; (2) expend such sum for such purpose; (3) levy the necessary tax therefore, to be levied and collected in annual installments in such years and in such amounts as may be determined by the Board of Education taking into account state aid; and (4) in anticipation of the collection of such tax, issue bonds and notes of the District and/or enter into installment purchase agreements at one time or from time to time in the principal amount not to exceed $250,000, and levy a tax to pay the interest on said obligations when due?

AND FURTHER NOTICE IS HEREBY GIVEN that the qualified voters of the School District shall be entitled to vote in said annual vote and election. A qualified voter is one who is (1) a citizen of the United States of America, (2) eighteen (18) years of age or older, and (3) resident within the School District for a period of thirty (30) days preceding the annual vote and election.  The School District may require all persons offering to vote at the budget vote and election to provide one form of proof of residency pursuant to Education Law section 2018-c.  Such form may include a driver’s license, a non-driver identification card, a utility bill, or a voter registration card.  Upon offer of proof of residency, the School District may also require all persons offering to vote to provide their signature, printed name and address.

NOTICE IS FURTHER GIVEN that absentee ballots will be available for this Election and Vote.  Applications for absentee ballots for the School District Election and Vote may be obtained at the Office of the District Clerk at the Webutuck High School building, Haight Road, Amenia, New York on school days.  The application must be returned to the District Clerk at least seven (7) days prior to the election if the ballot is to be mailed, or the day before the election if the ballot will be picked up personally by the voter. Absentee ballots must be received at the Office of the District Clerk by no later than 5:00 P.M., prevailing time, on the day of the Election and Vote, May 17, 2016.  A list of all persons to whom absentee ballots shall have been issued will be available for inspection to qualified voters of the District at the said District Administrative Offices during regular office hours, 9:00 A.M. to 4:00 P.M., prevailing time, including the day of the Election and Vote. Any qualified voter may file a written challenge of the qualifications of a voter whose name appears on such list stating the reasons for the challenge.

NOTICE TO BIDDERS

NOTICE IS HEREBY GIVEN that the TOWN Board of the TOWN of Amenia invites sealed proposals for the furnishing of all materials and labor necessary for installation of approximately 300 lineal feet of 5 foot wide concrete sidewalk and related work to be constructed along a section of U.S. Route 44 in the  Town of  Amenia, New York.  This Contract has been designated as Contract No. 16-001 as set forth in contract documents, including drawings and specifications, prepared by Morris Associates, Engineering & Surveying Consultants, PLLC, 9 Elks Lane, Poughkeepsie, NY 12601. All such sealed proposals must be received by the Town Clerk at the Town Hall, 4988 Route 22, Amenia, NY 12501 on or before June 9, 2016  at 10:00am, at which time they will be publicly opened and read aloud, for prompt consideration by the Town Board. 

Copies of the proposed contract documents, including plans and specifications, and the forms of proposals for the contract, are available for pick up and for public inspection at the Town Clerk’s office during business hours, Monday through Thursday 9:00 a.m. to 3:00 p.m. and become available May 12, 2016.  The refundable deposit for each set of plans and specifications is $50.00. All payments shall be in the form of a check or money order made payable to the Town of Amenia.  A CD-ROM containing electronic copies of the bid documents is included at the back of the specification book.Work shall consist mainly of:  Removal of approximately 140 LF of existing concrete/asphalt sidewalk; Installation of approximately 300 LF of 5 foot wide concrete side walk, including excavation, sub-base placement and compaction; Installation of Accessible Ramps and associated curb transitions at existing entrances; Installation of approximately 165 LF of concrete curbing; Installation of approximately 120 LF of split rail fence; Topsoil Seed and Mulch;Erosion and Sediment Controls; Maintenance and Protection of Traffic. Interested parties are invited to visit the location of the project at their convenience to review the scope of work prior to submission of bids. A formal pre-bid meeting will not be held.  The work shall be substantially completed within 60 calendar days of the date of the Notice to Proceed.All proposals shall be made and received upon the following conditions, which are more fully set forth in the bid documents:

1. Only such proposals as are made and filed upon the forms available in the Bid Documents will be accepted.

2. Proposals are to be enclosed in a sealed envelope.

3. Each proposal must be accompanied by a certified check in the sum of five percent (5%) of the amount bid, payable to the order of the Town of Amenia, or a bond with sufficient sureties, to be approved by the Supervisor, in such amount, conditioned that if the proposal is accepted, the bidder will enter into a contract for the same and will provide acceptable security, in the form of cash, certified check or performance bonds, or letters of credit, as set forth in the contract documents.

4. Pursuant to the provisions of GML 105, no bids may be withdrawn unless no contract is awarded for more than 45 days after the opening thereof.  

5. Upon acceptance of the bid, if the successful bidder fails to enter into a contract pursuant to the requirements of said  Town Board or fails to give the further security prescribed in this notice within the time noted herein, then the bid security deposited as aforesaid, and the moneys standing to the credit of the same shall be forfeited to the  Town as liquidated damages and not as a penalty and the  Supervisor  shall collect the same or enforce the payment of the bond for the benefit of the  Town.

6. All bids shall contain the non-collusion certificate in a form meeting the requirements of GML 103-d. 

The Town Board reserves the right, in its discretion, to waive technical noncompliance or irregularities that are not material or substantial, and to reject all bids and to rebid the project.
